The 3 Most Common Signs That You Can Sue For Malpractice
If you have ever had some surgery for a health problem or even for some kind of plastic surgery and had a bad experience then you have probably wondered what you can do about it. We expect when we go to a doctor that after we will feel better and be cured. This isn’t always the case. Sometimes things can be worse after treatment.
It’s tricky to understand if the failure to get better is a result of the doctor’s negligence or if the treatment simply didn’t work. There are signs to look for when this happens, however. If you see some of these signs then it means that you probably have a case to bring to your local Utah medical malpractice attorneys.
1 - Surgical errors
Sometimes a surgeon makes a mistake. They are human, after all. When a mistake is made, unfortunately, a person can lose their life or have serious side effects that impact them for the rest of their life.
When a mistake is made then you have a clear case for a medical malpractice case. What a mistake looks like can be different depending on the circumstances. For instance, a surgeon or ER nurse could leave some gauze or even a tool inside the patient which can cause some obvious issues.
Or, maybe the team was negligent in the sterilization of their tools and you got a serious infection. It’s up to you and your lawyer to prove that there was an undesirable outcome due to negligence and not just that the surgery didn’t work to treat your problem.
2 - You didn’t give informed consent
Surgery can only be done if you give them consent. Unless you are in a life or death situation like a car accident then you have to be informed of the surgery and what the potential side effects are. You then have to agree to the surgery and other types of treatment.
This means that if you were not given information and you didn’t consent then if there is a problem you could have a case. For example, if a doctor were to give you surgery on your back without telling you that there is a high chance of getting paralyzed then you would have a case if that were to happen.
3 - No aftercare
Treatment doesn’t usually finish right after the surgery. There needs to be some follow-up to make sure the healing is going as planned and there haven’t been any complications. It’s up to your doctor to make sure that you are well.
There are many things that need to be done after surgery or some form of treatment and when it isn’t done there is a risk of serious complications arising. Make sure to document if you had been trying to communicate and none was coming. Or, if they told you what the course of action would be and then never managed to put a plan in place for you.
